Terms and Conditions
By accessing or using the Pesipiuma application (the "Application" or "Service"), the User agrees to the following Terms and Conditions ("Agreement").
1. Ownership and Access Rights
BRAVER S.R.L. ("BRAVER") is the exclusive owner of the Application and grants the User a non-exclusive, non-transferable license to access and use the Application in accordance with this Agreement. The User may not assign, sublicense, or otherwise transfer such rights to any third party without BRAVER’s prior written consent. The User is responsible for maintaining the confidentiality of access credentials and must take all necessary measures to prevent unauthorized access.
2. Term and Renewal
This Agreement has an initial term of twelve (12) months starting from the date the account is activated by BRAVER. Upon expiration, it shall automatically renew for successive periods of the same duration (12 months), unless notice of termination is provided by either Party. The User may terminate the Agreement at any time, effective at the end of the current term, by sending written notice to BRAVER S.R.L. via certified email (PEC) at braver@pec.it.
3. Acceptable Use
The User agrees to use the Application in a lawful and appropriate manner and in compliance with applicable laws and regulations. BRAVER shall not be held liable for any consequences resulting from improper, unlawful, or unauthorized use of the Service.
4. Service Suspension
BRAVER reserves the right to suspend access to the Service in the event of a breach of these Terms and Conditions.
5. Subscription Fee and Payment Terms
The subscription fee and related payment terms are governed by the individual agreement entered into with each Client. For further details, please refer to the signed contract.
6. Technical Requirements
To access the Service, the User must use a compatible web browser (e.g., Safari, Chrome, Firefox) and maintain a stable high-speed internet connection (ADSL or higher).
7. Data Protection and Privacy
The Application processes only essential user data (such as email and password) for authentication purposes, securely managed via Amazon Cognito. BRAVER does not collect or store any personal or sensitive data beyond what is strictly necessary for account access. Technical files and uploaded images remain the exclusive property and responsibility of the Client.
8. Limitation of Liability
BRAVER shall not be liable for any indirect, incidental, or consequential damages, including but not limited to data loss, operational downtime, or third-party claims, arising from the use or inability to use the Application.
9. Amendments
BRAVER reserves the right to update or modify these Terms and Conditions at any time. Changes will become effective upon publication on the official website. Continued use of the Application after such updates constitutes acceptance of the revised terms.
10. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of Italy. Any disputes relating to the interpretation or execution of this Agreement shall fall under the exclusive jurisdiction of the Court of Padova, Italy.
11. Acceptance
Access to and use of the Application implies full acceptance of these Terms and Conditions. For corporate use, a signed copy of this document may be requested by contacting admin@braver.it or via certified email at braver@pec.it.
